WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISKS

Inherent Risk and Assumption of Risk: The undersigned Participant and/or Parent(s) or Guardian(s) acknowledges the Forever 7 Rodeo Association (“F7RA”) rodeo events are dangerous activities and that the participation in said events, as either a contestant, an employee, or volunteer, exposes the undersigned to serious and substantial hazards, risks of property damage, physical injury and/or death. The risks are not restricted to competition, but also include being in the arena, behind the chutes, in the livestock holding area, pens and any other area associated with bull rodeo events. 

 

Release of Liability. The undersigned Participant and/or Parent(s) or Guardian(s), and his/her next of kin, heirs, representatives, successors and assigns, being fully aware that participation in the F7RA rodeo events will expose him or her to a substantial and serious risk of property damage, physical injury, and/or death, unconditionally and irrevocably agree to assume all such hazards and risks and do hereby unconditionally and forever discharge, waive, hold harmless and release F7RA, its owners, members, agents, employees or assigns, and sponsors, and their subsidiaries, affiliates, officers, directors, shareholders, employees, members, agents, representatives, officials, judges, volunteers and other contractors, together with all other parties or entities involved in the sanctioning, approval, production, organization, conduct, sponsoring, advertising and performance of this event and activities for any matter relating to Participant’s participation in any events or relating to this waiver and release (and each such persons’ or entities’ affiliates, officers directors, employees, volunteers and agents) (collectively “Releasees”) from any and all claims, demands, losses, costs, liabilities and responsibilities arising from or in any way relating to Participant’s participation in or presence at any and all events by F7RA, its owners, members, agents, employees or assigns, and Releasees including any claims, demands, losses, costs, liabilities, or other responsibilities that are known or unknown, seen or unforeseen, future or contingent, and whether or not such claims, demands, losses, costs, liabilities, or other responsibilities are occasioned, in whole or in part, by the negligence of F7RA its owners, members, agents, employees or assigns and/or Releasees, or otherwise. 

 

Further, in consideration of being able to participate in this event, the undersigned Participant and/or Parent(s) or Guardian(s) hereby indemnifies and shall continue to indemnify and agree to hold harmless F7RA its owners, members, agents, employees or assigns and Releasees from any and all claims, liabilities, actions, and costs, asserted, made or threatened by any person (including without limitation, any employer, spouse, parent, child or other next of kin) in respect to all injuries and damage, personal injury or death occasioned by Participant by virtue of or arising out of Participant’s participation in the F7RA rodeo event. The undersigned Participant and/or Parent(s) or Guardians(s) will not now or at any time in the future, directly or indirectly, commence, threaten, or prosecute any claim, action, suit, or other proceeding against F7RA its owners, members, agents, employees or assigns, and/or Releasees, or any of them, arising out of or related to the claims, demands, liabilities and other responsibilities the undersigned Participant and/or Parent(s) or Guardian(s) assume, discharge, waive, and release by signing this Agreement. 

 

Acknowledgement of Understanding. The undersigned Participant and/or Parent(s) or Guardian(s) have read this Waiver, Release of Liability and Assumption of the Risks and fully understands its terms. The undersigned Participant and/or Parent(s) or Guardian(s) (1) knows and understands the nature of the activities conducted at F7RA rodeo events, (2) knows and understands the demands of those activities relative to the Participant's physical condition and skill level, and (3) appreciates the types of injuries which may occur as a result of participation in the activities conducted in F7RA rodeo events. The undersigned Participant and/or Parent(s) or Guardian(s) hereby assert that participation is voluntary and that the undersigned Participant and/or Parent(s) or Guardian(s) knowingly assumes all such risks. 

 

The undersigned Participant and/or Parent(s) or Guardian(s) acknowledge freely and voluntarily sign this Waiver, Release of Liability and Assumption of the Risks and intend their signatures to signify a complete assumption of the inherent risks of participating in activities at F7RA rodeo events to the greatest extent allowed by law in the State of Kansas. In signing this assumption this Waiver, Release of Liability and Assumption of the Risks as Parent or Guardian, you acknowledge that you are consenting to the Participant's participation in the activities conducted at F7RA rodeo events and acknowledge, both on behalf of Participant and/or the Parent(s) or Guardian(s), that Participant and Parent(s) or Guardian(s) expressly assume all inherent risks of the activity. 

 

The undersigned Participant and/or Parent(s) or Guardian(s) have read this Waiver, Release of Liability and Assumption of the Risks and fully understand its terms. The undersigned understands that Participant and/or Parent(s) or Guardian(s) are giving up substantial rights, including the right to compensation for injury resulting from ordinary negligence. The undersigned Participant and/or Parent(s) or Guardian(s) acknowledges that he/she is signing the agreement freely and voluntarily and intend his/her signature to be a complete, unconditional, and durable release of liability and waiver of liability to the greatest extent allowed by law in the State of Kansas. In signing this Waiver, Release of Liability and Assumption of the Risks as Parent(s) or Guardian(s), you acknowledge that you are consenting to the Participant's participation at F7RA’s rodeo event and acknowledge that you understand that any and all risks, including that of ordinary negligence, whether known or unknown, are expressly assumed by the Participant and/or Parent(s) or Guardian(s) and all claims, whether known or unknown, are expressly waived in advance. 

 

Acknowledgement of Understanding of Rules. The undersigned Participant and/or Parent(s) or Guardian(s) have read all applicable rules and regulations pertaining to F7RA rodeo events and hereby agrees to follow all applicable rules and regulations at all times. Severability, Venue, and Governing Law: The undersigned Participant and/or Parent(s) or Guardian(s) further expressly agree that this Waiver, Release of Liability and Assumption of the Risks shall be governed by and construed in accordance with the laws of the State of Kansas without giving effects to its rules regarding conflicts of laws and is intended to be as broad and inclusive as is permitted by the law of the State of Kansas. If any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Likewise, the undersigned, Participant and/or Parent(s) or Guardian(s) agree that if legal action is brought, it must be brought in the State of Kansas. 

 

Binding Effect. The undersigned Participant and/or Parent(s) or Guardian(s) further expressly agree that this Waiver, Release of Liability and Assumption of the Risks shall be binding upon the undersigned Participant and/or Parent(s) or Guardian(s) next of kin, heirs, representatives, successors, and assigns.
